Which Federal Laws Are Constitutional?
According to Thomas Jefferson in the Kentucky Resolution, written in response to the Alien and Sedition Acts:
Resolved, That the Constitution of the United States, having delegated to Congress a power to punish treason, counterfeiting the securities and current coin of the United States, piracies, and felonies committed on the high seas, and offences against the law of nations, and no other crimes whatsoever... and that the power to create, define, and punish such other crimes is reserved, and, of right, appertains solely and exclusively to the respective States, each within its own territory.
Senator Corker Responds
Senator Bob Corker of Tennessee responded to my earlier question. His answer was:
I share your concerns with the imposition of an individual mandate to purchase health insurance. Such a proposal would be an unprecedented step by the federal government to regulate the decisions made by individuals and families in their personal affairs. As Congress continues to consider a range of proposals for health care reform, the information you have provided will certainly help me and my staff more effectively look into this issue, and I assure that I will not support any proposal that goes beyond the limited powers granted to Congress by the Constitution.I replied:
Thank you for your response. Unfortunately, you did not answer my question. My question was, SPECIFICALLY where does the U.S. Constitution authorize the congress to require Americans to purchase health insurance? If you believe NOW that such a bill WOULD NOT be constitutional, please say so. If you believe that it WOULD be constitutional, please cite the Article and Section on which you rely to make this assertion. If you do not know, please state that you do not know.
